General Terms and Conditions

1. GENERAL PROVISIONS

The general terms and conditions of the company Viral d.o.o. on the website www.racman.eu (hereinafter: the General Terms and Conditions) are determined and regulated by Viral d.o.o., Podjelovo Brdo 19a, 4225 Sovodenj, Slovenia (EU), email info@racman.eu (hereinafter: the provider), which offers and executes the sale of products and other services (hereinafter: the online offer) on the website www.racman.eu. The General Terms and Conditions define the operation and use of the online services or online store within the website www.racman.eu, as well as the mutual rights and obligations of the provider and the user of the website services (the buyer; hereinafter: the customer). They are published on the website www.racman.eu and at the provider's headquarters.

An integral part of the General Terms and Conditions are also the Terms of Service of the website.

The services offered through the online offer, including the sale of products, are intended for legal entities and individuals and are available generally 24 hours a day, every day of the year. The provider reserves the right to change or discontinue specific services without prior notice.

The provisions of the General Terms and Conditions apply equally to all users of the online offer, except in cases where these terms explicitly state otherwise.

2. ONLINE PURCHASE

Products displayed on the pages of Racman www.racman.eu can be purchased through the provider's online offer/store on the website www.racman.eu (hereinafter: the online store).

Customers worldwide may place orders through the online store under the same conditions. In accordance with applicable EU rules, customers from all EU Member States are not subject to discrimination based on nationality, place of residence, or place of establishment.

Delivery availability may vary only due to objective circumstances, such as carrier restrictions, safety risks, sanctions, customs limitations, or force majeure.

The provider does not operate a traditional retail store at its registered office.

2.1. SEARCHING FOR PRODUCTS

The customer can search for desired products within the "Shop" section, which contains the full range of products for sale, categorized by their intended use or purpose, or by using the search engine, which is suitable for finding a specific product.

Search Engine:

The search engine allows for searching products by name, keywords, or product data, as well as by collections. In case of searching by product name and desired data (material, properties, purpose, etc.), the product name or data about properties, purpose, etc., should be entered in the empty "Search" field, and the search should be confirmed by clicking on the "Search" icon. Searching with multiple words in any order is supported.

Within the group (category) search, users can search for all products that fall into a particular category or group based on their intended use. The customer selects the desired search group and confirms it by clicking the "Search" icon.

2.2. PRODUCT OFFER

Within the "Shop" section or the search engine, selected products are displayed with an image, name, and price. By clicking on the image or the name of a specific product, a detailed description of the product is shown, including available sizes, designs, and colors (which the customer can view or select in the search box), as well as the product image. By clicking on the image, a zoomed-in view of the product is displayed.

2.3. SHOPPING CART

Next to each product display, there is an "Add to Cart" icon that enables the beginning of shopping in the online store – adding products to the cart or order list. The "Cart" icon allows tracking the contents of the purchase.

2.4. ORDER PROCESS

  1. For the selected product, choose the desired size, design, or color, and the quantity you wish to order.
  2. Click on the "Add to Cart" icon to add the product to the shopping cart.
  3. Additional products can be added to the cart either by clicking on the "Continue Shopping" line in the "Cart" box or by selecting an individual product through searching in the "Shop" or "Search" sections.
  4. Reviewing the Cart Contents: While shopping, you can continuously monitor the cart’s contents. The "Your cart" allows you to review the products selected for purchase, their price, quantity, and the total or total price of the ordered quantity for each product. The "Cart Contents" section allows you to check the number of selected items and their total price.
  5. Modifying Cart Contents: By clicking on the name of a product in the cart, the shopping window for that product opens, where you can change the design, color, and size of the products in the cart. The quantity of selected products in the cart can also be changed directly in the cart by adjusting the quantity number in the "Quantity" field for each individual product in the horizontal row. Individual products can be removed from the cart by clicking the "Remove" button (represented by an "trash bin" icon) in the horizontal row of that product.
  6. If you have a discount code, you can enter it and confirm its use by clicking the "Apply" button.
  7. Below the ordered products or the order, you can view the shipping cost, the total price of the order including VAT, the tax amount, and the final amount to be paid for the order.
  8. Entering Order Data: In the relevant fields, select the payment method (prepayment, credit card, PayPal) and the delivery method (delivery via FedEx). The order will be delivered via FedEx to the delivery address provided by the customer in the order. If the customer wishes delivery to another person or address, other than the one provided, they should check the box "Use a different billing address" and fill in the required fields with the name and address.
  9. Entering Customer Data: In the relevant fields, enter the customer's first and last name/business name, the delivery address, city, phone number, and email address. Optionally, you can enter special wishes, requirements, or other comments in the "Order special instructions" field.
  10. Newsletter Subscription: If you wish, you can also subscribe to receive newsletters about the company's activities when submitting your order – in this case, check the "Subscribe me to the newsletter" box.
  11. Acceptance of General Terms and Conditions: The customer confirms that they are familiar with the general terms and conditions and acknowledges them by checking the box that indicates they accept these terms.
  12. Final Order Review: Review the order details, and if they are correct, confirm the order by clicking the "Order and Pay" button.
  13. By clicking the "Order and Pay" button, the customer expressly acknowledges that the order implies an obligation to pay.

2.5. ORDER FULFILLMENT

Immediately after placing the order, the customer will receive a confirmation email to the address provided in the order. This email contains details about the ordered products, including the ordered quantity and their prices, delivery method & costs, any applicable discounts, the total amount to be paid.

The confirmation email also includes or provides access to these General Terms and Conditions in a durable medium, valid at the time of purchase.

If there are any uncertainties, additional questions, or if the customer does not receive the order confirmation, they can email us at info@racman.eu or use the chat option (available Monday to Friday, 8:00–14:00 CET).

On the day of shipment, the provider will notify the customer via email address provided in the order. The provider will also send the shipment tracking number, which allows the customer to track the shipment.

Upon receiving the ordered products, the customer will also receive product declarations and an invoice in paper form.

If the customer requires the invoice for business purposes (e.g., sole proprietorship, LLC, etc.), they should indicate the exact name of the invoice recipient in the section "Order special instructions" of the "Your cart" window.

2.6. PRICES

The prices applicable to the purchase are the prices displayed at the moment the customer submits the order.

All prices include VAT. Prices are subject to change without prior notice. Any price changes apply only to future orders and do not affect orders already submitted.

2.7. PURCHASE AGREEMENT

The purchase agreement between the provider and the customer is concluded at the moment the customer submits the order through the online store. Before submitting the order, the customer is enabled to review the full order, including the selected products, quantities, price, delivery costs and total payment obligation. After the order is submitted, the customer receives an automatic email confirmation of receipt of the order containing the order summary. From the moment of submission of the order, the prices and other terms are those displayed at the time of order submission.

The purchase agreement is concluded in the English language.

The concluded agreements between the provider and the customer, orders, and copies of invoices are kept at the provider’s headquarters: Viral d.o.o., Podjelovo Brdo 19a, 4225 Sovodenj, Slovenia (EU). The customer can request a written copy of the agreement, invoice, or other documentation related to the purchase by sending a written request to the above address of the provider’s headquarters or by email to: info@racman.eu.

2.8. PAYMENT METHODS

The provider offers the following payment methods for purchases in the online store (the customer selects the method when placing the order, as described in the purchase process):
-    Credit cards
-    PayPal
-    Prepayment

If the customer chooses prepayment, they must transfer the payment amount to the transaction account and use the reference number provided in the order confirmation, which also serves as the proforma invoice.

2.9. DISCOUNTS

The provider offers the following discounts:
-    Orders between 100€ and 200€ receive a 3% discount on the total purchase amount;
-    Orders between 200€ and 300€ receive a 5% discount on the total purchase amount;
-    Orders above 300€ receive a 7% discount on the total purchase amount.

Promotional Offers

Promotions are valid within the published period or until stocks run out.

2.10. SHIPPING METHOD AND DELIVERY TIME

Orders are dispatched from our facilities in Slovenia (EU) and delivered by FedEx to the desired address. Typically, the orders are shipped within two working days after payment is received, and the customer will be notified of this via email (the process is described in section 2.5 "Order Fulfillment").

If the ordered product is out of stock or the delivery time is longer than the timeframe specified in the previous paragraph, the provider will immediately inform the customer.

The provider offers delivery worldwide. The contractual partner for delivery is FedEx, which typically delivers packages within the EU in up to 7 business days, while international shipments may take up to 14 business days.

Delivery times may vary depending on the destination country and the carrier’s service conditions. In exceptional circumstances beyond the provider’s control, including but not limited to war, sanctions, export or import restrictions, customs barriers, carrier interruptions, or other force majeure events, delivery to certain countries or territories may be temporarily unavailable or delayed.

If you are not at home or unavailable at the chosen address, you will receive a notification from the carrier in accordance with local delivery practice, and your package will be available for collection or redelivery according to the carrier’s rules in the destination country.

2.11. SHIPPING COSTS

The buyer is charged a flat shipping cost of 7€ for deliveries to all countries worldwide. However, orders over 30€ qualify for free shipping.

The applicable shipping costs are clearly displayed to the customer before the order is submitted and before the customer is bound by the contract.

2.12. IMPORT DUTIES & TAXES

Prices include VAT where applicable. For deliveries within the European Union, the customer will not be charged additional import duties or customs clearance fees upon delivery.

For deliveries outside the European Union: any import duties, customs fees, or taxes charged by the destination country are not included and remain the responsibility of the customer.

2.13. RIGHT OF WITHDRAWAL

The customer has the right to inform the provider in writing at Viral d.o.o., Podjelovo Brdo 19a, 4225 Sovodenj, Slovenia (EU) or via email at info@racman.eu within 14 days that they are withdrawing from the contract, without needing to provide a reason for their decision. The customer may use the standard withdrawal form available on the website, but its use is not mandatory.

If the customer has already received the goods and decides to withdraw from the contract or purchase, they must return the unused and unwashed goods to the provider within 14 days of the notice mentioned in the previous sentence. The customer is responsible for any decrease in the value of the goods if the reduction in value is a result of actions that were not necessary to determine the nature, properties, and functioning of the goods. The customer may examine the goods as they would if they were buying the product in a physical store.

The only cost that the customer will incur in relation to the withdrawal from the contract is the direct cost of returning the goods. However, if the return is due to our mistake or a defective product, we will cover the shipping costs.

Returning the received goods to the provider within the withdrawal period is considered as notification of the withdrawal from the contract.

In the case of withdrawal from the purchase under the above terms, the provider will refund all payments made by the customer as soon as possible, but no later than 14 days after receiving the notice of withdrawal from the contract or purchase. The provider shall reimburse the customer using the same means of payment as the customer used for the initial transaction, unless the customer has expressly agreed otherwise. The provider shall reimburse the costs of the standard delivery option offered to the customer. Any additional costs resulting from the customer’s express choice of a type of delivery other than the least expensive standard delivery offered by the provider shall not be reimbursed.

The provider may withhold reimbursement until the returned goods are received or until the customer supplies evidence of having sent back the goods, whichever is earlier.

In accordance with the Consumer Protection Act, the customer does not have the right to withdraw from the contract if the subject of the contract is custom made goods according to the customer's specifications or personalized to their needs.

2.14. LEGAL GUARANTEE OF CONFORMITY

The provider is liable for any lack of conformity of the goods in accordance with the applicable consumer protection legislation.

A lack of conformity exists in particular where:

1.    The item does not have the characteristics necessary for its normal use or for trade;
2.    The item does not have the characteristics necessary for a specific use that the customer is purchasing it for, which was known to the provider or should have been known to them;
3.    The item does not have the characteristics and qualities that were explicitly or implicitly agreed upon or prescribed;
4.    The provider delivered an item that does not match the sample or model, unless the sample or model was shown only for informational purposes.

Goods are in conformity with the contract in particular when they correspond to the description, type, quantity and quality, and possess the functionality, compatibility and other characteristics normal for goods of the same type and which the customer may reasonably expect given the nature of the goods and taking into account any public statements made by the provider.

The provider is liable for any lack of conformity that exists at the time of delivery and becomes apparent within two years from delivery of the goods.  

The customer may exercise rights arising from lack of conformity by notifying the provider within two months from the day the lack of conformity was discovered and by allowing the provider to inspect the goods.

In the event of a lack of conformity, the customer is entitled to request that the goods be brought into conformity free of charge by repair or replacement. If this is not possible or not carried out within a reasonable time, the customer may request a proportionate reduction of the price or withdraw from the contract and request reimbursement, unless the lack of conformity is minor.

3. SERVICES

The general terms and conditions in this section define the conditions for the provision of services by the provider, as listed within the online offer.

The provisions of Section 2 of the general terms and conditions: "Online purchase" and other provisions of the general terms and conditions apply appropriately to the provision of services, unless otherwise specified in this chapter of the general terms and conditions.

Orders for the provision of services are accepted by the provider via their website at www.racman.eu. By placing an order, the customer confirms that they are familiar with the general terms and conditions and accept them.

The description of the execution of each service, including the provider's obligations and responsibilities, is provided for each service in the "Services" section.

The provider only performs services (such as repairs, etc.) for Racman products, which are delivered to the provider personally or by mail by the customer.

The ordered services will, as a rule, be performed, and the products with completed services will be shipped or made ready for collection within five working days after the confirmation of the order and receipt of the products for service execution. In the case of payment by pro forma invoice, the services will be completed within five working days after receiving the payment and the products for service execution, and the customer will be notified by email.

4. PERSONAL DATA PROTECTION

By placing an order online, the customer agrees that the provider will collect and process personal data provided by the customer, which is necessary and appropriate for fulfilling the rights and obligations arising from the contractual relationship. The provider will use the customer's personal data exclusively for order fulfillment and the necessary communication related to it.

The provider collects and processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable national data protection legislation.

Upon request, the provider must supplement, correct, block, or delete personal data if the individual or customer proves that the data is incomplete, inaccurate, outdated, or has been collected or processed in violation of the law.

Detailed information on the purposes of processing, legal bases, storage periods, recipients of personal data, and the rights of data subjects is available in the Privacy Policy, which forms an integral part of these General Terms and Conditions.

5. INFORMATION, COMPLAINTS, REQUESTS, AND STATEMENTS

The customer may send their opinions, remarks, complaints, requests, and other statements to:

The provider will carefully review every remark and opinion from a customer and will provide a response within ten working days.

6. USE AND INTERPRETATION OF THE GENERAL TERMS AND CONDITIONS

For all relationships, rights, and obligations of the contracting parties that are not specifically defined by these general terms and conditions, the provisions of the Obligations Code and the Consumer Protection Act shall apply.

7. DISPUTE RESOLUTION

Any disputes arising between the provider and the customer shall be resolved amicably where possible. If this is not possible, the dispute shall be resolved by the court having jurisdiction under the applicable law. This does not affect any mandatory consumer protection rules on jurisdiction that apply in the customer’s country of residence. 

The provider does not currently participate in any out-of-court consumer dispute resolution scheme, unless required by mandatory law.

8. VALIDITY

The general terms and conditions are valid from March 25th, 2026.
